hereinafter referred to as the "Rentel Provider".
2. Subject Matter and Scope of the General Terms and Conditions
2.1. These General Terms and Conditions / Rental Terms (hereinafter referred to as the "GTC") set out the general terms governing the electric bicycle rental services provided under the My eBike brand.
2.2. These GTC form an integral part of each individual electric bicycle rental agreement (hereinafter referred to as the "Rental Agreement") concluded between the Rental Provider and the Renter, and shall govern all matters not expressly regulated by the Rental Agreement.
2.3. These GTC shall apply exclusively to rental relationships where the Rental Agreement is concluded in person, in paper form, and signed by both Parties.
2.4. In the event of any inconsistency between the provisions of the Rental Agreement and these GTC, the individual provisions of the Rental Agreement shall prevail with respect to the relevant rental.
2.5. By signing the Rental Agreement, the Renter acknowledges and declares that, prior to conclusion of the Rental Agreement, they have received these GTC or have been given an adequate opportunity to review them, that they accept their provisions, and that they agree to be bound by them.
3. Definitions
3.1. Rental Provider: the service provider identified in Section 1 of these GTC.
3.2. Renter: a natural person who is at least 18 years of age and has full legal capacity, who enters into a Rental Agreement with the Rental Provider, rents the Bicycle for their own use or for the use of a User designated by them, and is responsible for fulfilling all obligations arising from the Rental Agreement.
3.3. User: the person who actually uses the Bicycle rented by the Renter.
3.4. Parties: the Rental Provider and the Renter, collectively.
3.5. Bicycle: the electric bicycle individually identified in the Rental Agreement and the Handover Report, including all of its accessories and equipment, unless otherwise provided in these GTC.
3.6. Accessory: any item supplied together with the Bicycle, including, but not limited to, a helmet, lock, key, charger, battery, repair kit, phone holder or any other accessory supplied with the Bicycle.
3.7. Rental Period: the period between the commencement and end date and time specified in the Rental Agreement, including any agreed extension thereof.
3.8. Partner: an accommodation provider or other cooperating entity that collaborates with the Rental Provider by recommending the Rental Provider's services to its guests or customers and, subject to the Renter's consent, may forward the Renter's enquiry to the Rental Provider. The Partner shall not become the rental provider under the Rental Agreement.
3.9. Price List: the Rental Provider's current schedule of fees, made available to the Renter in advance, including, in particular, rental fees, the Security Deposit, delivery and collection charges, and any other applicable fees.
4. Booking, Preliminary Arrangements and Conclusion of the Rental Agreement
4.1. The Renter may submit a rental request either directly to the Rental Provider or through a Partner. Subject to the Renter's consent, the Partner shall forward the enquiry to the Rental Provider. The Rental Provider shall then contact the Renter directly to arrange the details of the booking. A booking shall only become valid upon confirmation by the Rental Provider.
4.2. Any preliminary enquiry or request for quotation shall not in itself create a rental relationship. In all cases, the Rental Agreement shall be concluded in person, in paper form, and signed by both Parties. The provisions of Section 17 of these GTC shall otherwise apply to the relationship arising from a booking.
4.3. The Rental Provider shall be entitled to refuse the rental, in particular if:
a) the Renter is under 18 years of age;
b) the Renter's identity cannot be verified;
c) the Renter fails to pay the rental fee or the Security Deposit no later than the handover of the Bicycle;
d) in the opinion of the Rental Provider, the Renter is under the influence of alcohol, drugs or any other substance that may impair their ability to use the Bicycle safely;
e) based on the Renter's behaviour or physical or mental condition, the Renter is clearly unfit to use the Bicycle safely;
f) due to hazardous weather conditions, technical reasons, lack of availability or any other circumstance beyond the Rental Provider's control, the rental cannot be carried out safely;
g) the Renter refuses to sign the Rental Agreement or does not accept these GTC.
4.4. The Rental Provider reserves the right to offer a Bicycle of the same or a similar category instead of the Bicycle originally agreed if the originally agreed Bicycle is unavailable or cannot be handed over for technical, safety or other reasons. If no suitable replacement Bicycle is available, the Parties may cancel the rental by mutual agreement. In such case, any booking fee or rental fee paid in advance by the Renter shall be refunded. However, if the Renter refuses to accept the previously agreed and delivered Bicycle at the location for reasons not attributable to the Rental Provider, or cancels the rental on site, the Renter shall be obliged to pay the delivery charge, which the Rental Provider shall also be entitled to deduct from the booking fee.
4.5. By signing the Rental Agreement, the Renter warrants that all information provided by them is true, accurate and up to date.
5. Rental Requirements
5.1. The rental of a Bicycle is subject to the following conditions:
a) provision of the personal data required for performance of the Rental Agreement;
b) verification of the Renter's identity by means of a valid photographic identification document;
c) signing of the Rental Agreement and acceptance of these GTC;
d) payment of the rental fee and the Security Deposit; and
e) completion and signing of the Handover Report.
5.2. The Rental Provider shall be entitled to verify the Renter's identity by requesting presentation of a valid photographic identification document. The detailed rules governing the processing of personal data are set out in the Rental Provider's separate Privacy Notice.
5.3. The Renter may rent the Bicycle in their own name and at their own responsibility for their own use or for the use of a User designated by them. The Bicycle may not be handed over to any other person not previously designated, may not be sublet, and its use may not otherwise be transferred to another person. The Renter shall be liable for all damages and costs arising from any breach of this provision.
6. Rental Fee, Security Deposit and Payment
6.1. The rental fee, the Security Deposit, the delivery and collection charges, and the fees for any additional services shall be specified in the Rental Agreement and/or the Price List.
6.2. The rental fee constitutes consideration for the use of the Bicycle and for making it available for the Rental Period specified in the Rental Agreement.
6.3. Payment of the rental fee and the Security Deposit is a prerequisite for handover of the Bicycle.
6.4. The Rental Provider accepts the following methods of payment: cash; bank card; bank transfer; or any other method of payment agreed in advance by the Parties.
6.5. The Security Deposit serves as security for the Renter's contractual obligations. The amount of the Security Deposit shall be specified in the Rental Agreement in accordance with the Price List. The Security Deposit shall be refunded if the Bicycle and its Accessories are returned in accordance with the Rental Agreement, complete, undamaged and on time.
6.6. The Rental Provider shall be entitled to deduct from the Security Deposit any duly documented and reasonable costs, fees and damages arising from the Renter's breach of contract or from circumstances for which the Renter is responsible, including, in particular, repair, replacement, depreciation, cleaning, late return, recovery assistance, call-out, delivery or collection charges and costs. The detailed rules governing liability for damages are set out in Section 15 of these GTC.
6.7. The Security Deposit is provided as security and its amount shall not limit the Renter's liability for damages or other payment obligations. If the Rental Provider's duly documented loss, costs or other claim against the Renter exceed the amount of the Security Deposit, the Rental Provider shall be entitled to recover the outstanding balance from the Renter after applying the Security Deposit. The Renter shall pay any amount not covered by the Security Deposit within the deadline specified in the Rental Provider's written notice.
6.8. No interest shall accrue on the Security Deposit.
7. Handover of the Bicycle
7.1. The Bicycle shall be handed over at the location and time specified in the Rental Agreement.
7.2. The Bicycle may be handed over, in particular, at a handover point designated by the Rental Provider, at the Partner's accommodation, or at any other location agreed in advance by the Parties.
7.3. The Rental Provider shall hand over the Bicycle in a checked condition suitable for its intended use. Upon taking possession, the Renter shall inspect the Bicycle, its Accessories and its basic operation, and shall ensure that any visible defect, damage, missing item or objection is recorded in the Handover Report. If the Renter accepts the Bicycle without objection and signs the Handover Report, the Bicycle and its Accessories shall be deemed to have been received in the condition recorded therein.
7.4. The Rental Provider shall be entitled to refuse to hand over the Bicycle in any of the circumstances set out in Section 4.3 of these GTC.
7.5. If the Renter fails to appear at the handover time specified in the Rental Agreement, or if handover cannot be completed for reasons attributable to the Renter, the Rental Provider shall not be obliged to extend the Rental Period or provide an alternative handover time. The Parties may agree otherwise in writing on an individual basis.
8. Use of the Bicycle
8.1. The Bicycle may only be used by the Renter or the User designated by the Renter for its intended purpose, with due care, and in accordance with the information and instructions provided by the Rental Provider, the manufacturer's instructions, the Rental Agreement and these GTC.
8.2. The Renter shall ensure that both the Renter and the User are fit to use the Bicycle and comply with the rules governing its use as set out in these GTC and the Rental Agreement. The Renter shall be liable for the conduct of the User as if it were their own.
8.3. The Renter and the User shall comply with the applicable road traffic rules, in particular the Hungarian Highway Code (KRESZ). The Bicycle shall in all cases be used at the actual User's own risk.
8.4. The Renter represents and warrants that both the Renter and the designated User are in the physical, mental and health condition necessary for the safe use of the Bicycle and are familiar with the basic riding characteristics and features of an electric bicycle.
8.5. The use of a helmet is recommended while using the Bicycle. The Renter shall be responsible for the consequences arising from failure to wear a helmet.
8.6. The Bicycle may be used:
a) on public roads, in compliance with the applicable traffic regulations;
b) on cycle paths;
c) on light unpaved roads;
d) on gravel roads, provided that the road conditions allow safe use.
8.7. The Bicycle shall not be used:
a) on downhill tracks or in bike parks;
b) for jumping or racing;
c) on extreme off-road terrain;
d) in water, deep mud or any environment that may endanger the Bicycle's electrical system;
e) while under the influence of alcohol, drugs or any substance impairing the ability to operate the Bicycle safely;
f) for any unlawful purpose;
g) for carrying passengers or goods where such use is incompatible with the intended use of the Bicycle;
h) in any manner that endangers the Bicycle or the safety of the Renter, the User or any third party.
8.8. The Renter and the User shall not dismantle, modify or repair the Bicycle, battery, charger, GPS device or any other Accessory, nor arrange for their repair, alter them or interfere with their operation.
8.9. The Renter shall ensure that, whenever the Bicycle is not in use, it is locked and stored in a safe location and that all reasonable measures are taken to prevent theft, loss, damage or vandalism.
8.10. The Bicycle may only be transported with the prior consent of the Rental Provider. When transporting the Bicycle, the Renter or User shall take into account the weight and specific characteristics of the electric bicycle and shall use only suitable and secure bicycle transport equipment. The Renter shall be liable for any damage resulting from improper transportation.
9. Battery, Charging and Electrical System
9.1. The Renter and the designated User shall use the battery, charger and electrical system only for their intended purpose and in accordance with the information and instructions provided by the Rental Provider and the manufacturer's instructions. The Bicycle battery may only be charged using the charger supplied by the Rental Provider and a standard 220 V mains power supply.
9.2. The following are prohibited:
a) dismantling or opening the battery;
b) using a non-original charger or any charger other than that supplied by the Rental Provider;
c) immersing the battery in water, cleaning it with a high-pressure washer, or cleaning it in any manner that may endanger the electrical system;
d) modifying the electrical system in any way;
e) using a damaged battery or charger;
f) storing the battery in direct sunlight, near a heat source, or in a damp or otherwise unsafe location.
9.3. The Renter acknowledges that the Bicycle's range is affected by several factors, including, in particular, the weight of the actual User and any luggage, road conditions, elevation changes, weather, tyre condition, the level of pedal assistance and riding style. Any range information provided by the Rental Provider is for guidance only.
9.4. The Renter and the designated User shall monitor the battery charge level and plan the Rental Period, route and return journey accordingly. The Renter shall be responsible for any consequences arising from the User's failure to comply with this obligation.
10. GPS Tracking
10.1. The Renter acknowledges that the Bicycle is equipped with a GPS tracking device and shall also inform any designated User thereof.
10.2. The GPS device is intended in particular for the protection of the Bicycle, the prevention of theft, locating a lost or stolen Bicycle, and facilitating its recovery.
11. Breakdown and Assistance
11.1. The Renter shall immediately notify the Rental Provider of any breakdown, malfunction, damage or other circumstance preventing use of the Bicycle. Where the Bicycle is used by a designated User, the Renter shall ensure that the User immediately reports any defect or damage incident they observe either to the Renter or directly to the Rental Provider. The Renter shall be responsible for any consequences arising from the User's failure to do so.
11.2. In the event of a breakdown, the Renter or User may continue using the Bicycle only if, based on information provided by the Rental Provider, it is safe to do so. If continued use may aggravate the defect or create a risk of accident, use of the Bicycle shall cease immediately.
11.3. The Renter and the User shall not repair or arrange for the repair of the Bicycle without the prior consent of the Rental Provider.
11.4. In the event of a breakdown or damage incident, the Rental Provider shall provide telephone assistance and, following consultation with the Renter, determine the appropriate course of action. Subject to the conditions set out herein, the Rental Provider may provide recovery assistance during daytime hours at locations accessible by motor vehicle. Such assistance may include, in particular, on-site inspection, transportation or replacement of the Bicycle, or any other reasonable measure agreed with the Renter.
11.5. Where the breakdown results from the Renter's breach of contract, improper use by the Renter or User, culpable conduct (for example, inappropriate route selection or continuing to travel with a depleted battery), or another circumstance within the Renter's sphere of responsibility, the Renter shall bear all duly documented and reasonable resulting costs, including, in particular, repair, recovery, call-out or replacement costs, the mileage charge specified in the Price List, and any necessary material and labour costs.
11.6. Where the breakdown is attributable to the Rental Provider or occurs during proper use of the Bicycle, the Rental Provider shall, where reasonably possible, offer repair, replacement, recovery or another reasonable solution. If recovery is required due to a technical problem for which the Renter is not responsible, the Rental Provider shall provide recovery assistance free of charge during daytime hours, at a location accessible by motor vehicle and subject to available capacity.
11.7. Recovery assistance shall not constitute continuous availability or a guaranteed on-site repair service. It shall be provided solely subject to the Rental Provider's available capacity, opening hours, availability, weather and traffic conditions, and the geographical service area.
12. Damage, Accident, Theft and Loss
12.1. The Renter shall immediately notify the Rental Provider of any accident, theft, misappropriation, loss, damage caused to a third party or intervention by an authority.
12.2. In the event of an accident, personal injury, theft, misappropriation or damage caused to a third party, the Renter shall take any necessary official measures, including, in particular, making a police report or filing a criminal complaint where justified by the nature of the incident.
12.3. In the event of theft or misappropriation, the Renter shall immediately notify the Rental Provider, file a police report, provide proof thereof to the Rental Provider, and cooperate in locating the Bicycle.
12.4. The Renter shall provide a truthful account of the circumstances of any damage incident. The incident shall be recorded by the Parties or, where necessary, by the Renter on a damage report form or in a written record.
12.5. The Renter shall assist in documenting the incident, including, where it is safe to do so, by taking photographs of the location, the Bicycle, and any damage or missing items.
13. Return of the Bicycle
13.1. The Renter shall return the Bicycle together with all Accessories at the time and location specified in the Rental Agreement.
13.2. The Bicycle shall be returned in a clean and readily inspectable condition. Dust resulting from normal use shall not constitute a breach of contract.
13.3. If the Bicycle is returned muddy, excessively dirty or in a condition requiring special cleaning by the Rental Provider, the Rental Provider shall be entitled to charge the cleaning and maintenance fee specified in the Price List.
13.4. The Bicycle shall not be cleaned using a high-pressure washer. The Renter shall be liable for any damage resulting from high-pressure cleaning, improper cleaning or water ingress into the electrical system.
13.5. Upon return, the Rental Provider shall inspect the condition of the Bicycle and its Accessories. Any damage, missing items, excessive dirt, late return and any circumstances relevant to settlement of the Security Deposit shall be recorded in the Handover Report or in a separate written record.
13.6. Unless otherwise agreed, the Renter shall not be entitled to a proportional refund of the rental fee if the Bicycle is returned before the end of the Rental Period.
13.7. The Renter shall not retain possession of the Bicycle or its Accessories on the grounds of any actual or alleged claim, objection or demand against the Rental Provider. Any such claim may be pursued separately, independently of the obligation to return the Bicycle.
14. Late Return
14.1. A return shall be deemed late if the Renter fails to return the Bicycle by the return time specified in the Rental Agreement. The Renter shall immediately notify the Rental Provider of any delay.
14.2. Unless otherwise agreed, the Rental Provider allows the following grace period: 30 minutes for hourly rentals and 1 hour for daily rentals.
14.3. Where the delay exceeds the applicable grace period, the Rental Provider shall be entitled to charge the late return fee specified in the Price List.
14.4. If the delay causes the Rental Provider to incur additional loss or costs, or prevents performance towards another renter, the Rental Provider shall be entitled to recover duly documented loss exceeding the late return fee.
14.5. If the Renter fails to return the Bicycle within 24 hours after expiry of the Rental Period and fails to cooperate with the Rental Provider, the Rental Provider shall be entitled to take the asset-protection, official and legal measures necessary to locate and recover the Bicycle.
14.6. The Rental Period may only be extended with the prior consent of the Rental Provider and subject to availability. The Renter shall discuss any requested extension with the Rental Provider by telephone before expiry of the Rental Period and subsequently confirm the request by e-mail. The extension shall only be deemed accepted if the Rental Provider confirms it by e-mail, issues an invoice for the extension fee and the Renter pays the extension fee specified in the Price List. By submitting a request for an extension, the Renter acknowledges that acceptance of the extension will give rise to an additional payment obligation.
15. Liability, Damage and Allocation of Loss
15.1. The Renter shall be liable for all damages and costs arising from the Renter's breach of contract, improper use by the Renter or User, negligent or intentional conduct, breach of traffic regulations, or breach of the rules concerning use and safeguarding set out in these GTC or the Rental Agreement.
15.2. The Renter's liability includes, in particular, loss of, missing parts of or damage to the Bicycle or its Accessories; circumstances attributable to the Renter in connection with theft or misappropriation; damage to the battery, charger, GPS device or electrical system; damage resulting from improper transportation; and any fines, surcharges or other costs imposed on the Rental Provider where attributable to the conduct of the Renter or User.
15.3. Normal wear and tear resulting from proper use shall not constitute damage.
15.4. The Renter shall be released from liability if they prove that the damage did not result from the conduct of the Renter or User, from improper use of the Bicycle, or from a circumstance within the Renter's sphere of responsibility.
15.5. The amount of damage shall be determined by the Rental Provider on the basis of the nature of the damage, the expected or actual repair or replacement costs, depreciation and, where necessary, a quotation from a service provider or distributor. The Rental Provider shall inform the Renter of the basis of the assessment.
15.6. The Renter shall reimburse the cost of repairing or replacing the Bicycle or any Accessory and, where economical repair is not possible, or in the event of destruction, loss or failure to return it, the replacement value thereof, together with any duly documented related costs.
16. Insurance
16.1. Unless otherwise stated in writing, the Rental Provider does not provide insurance services.
16.2. The Renter acknowledges that, in connection with use of the Bicycle, it is the Renter's responsibility to arrange any accident, health, property or liability insurance they consider necessary for themselves and, where applicable, for the designated User.
17. Booking, Cancellation and Amendments
17.1. If the Renter wishes to amend or cancel a previously arranged rental date, they shall notify the Rental Provider as soon as possible. The Rental Provider shall only be obliged to accommodate a requested amendment subject to availability. For an advance booking, the Rental Provider shall charge the fee specified in the Price List, which shall be credited towards the rental fee.
17.2. If the Renter fails to appear at the booked time or fails to take possession of the Bicycle for reasons attributable to the Renter, the Rental Provider shall be entitled to cancel the advance booking. In such case, the advance booking fee already paid shall be non-refundable. The Renter may cancel the rental free of charge no later than 72 hours before commencement of the rental, in which case the advance booking fee shall be refunded.
17.3. The Rental Provider shall be entitled to cancel or amend the rental or advance booking without liability for damages if justified by exceptional weather conditions, technical failure, risk of accident, lack of availability or any other circumstance beyond the Rental Provider's control (force majeure). In such case, the Rental Provider shall, where reasonably possible, offer an alternative date, another Bicycle or another fair solution; failing this, any advance booking fee already paid shall be refunded.
18. Warranty
18.1. The Rental Provider warrants that, at the time of handover, the Bicycle is suitable for its intended use.
18.2. The Renter shall not be entitled to make a claim in respect of any cosmetic defect or damage that does not prevent the intended use of the Bicycle and that was known at the time of handover or recorded in the Handover Report.
18.3. If, during the Rental Period, the Bicycle becomes unusable for reasons not attributable to the Renter or User, the Rental Provider shall proceed in accordance with Section 11.
18.4. The Rental Provider shall not be liable where use of the Bicycle is prevented by a circumstance attributable to the Renter or User, including, in particular, improper use, inappropriate route selection, inadequate physical condition, improper handling of the battery, or weather, road or other conditions not attributable to the Rental Provider.
19. Data Protection
19.1. The detailed rules governing the processing of the personal data of the Renter and, where applicable, the User are set out in the Rental Provider's Privacy Notice.
20. Complaints Handling
20.1. The Renter may submit any complaint relating to the rental, the Bicycle or the Rental Provider's services using the contact details specified in Section 1.
20.2. The Rental Provider shall, where possible, examine verbal complaints immediately and remedy them as necessary. If immediate investigation of a verbal complaint is not possible, or if the Renter does not agree with the handling of the complaint, the Rental Provider shall prepare a written record.
20.3. The Rental Provider shall provide a substantive written response to a written complaint within 30 days of receipt. If the complaint is rejected, the Rental Provider shall state the reasons for its position.
20.4. In the event of a consumer dispute, the Renter shall be entitled to apply to a conciliation body. 21. Amendments to the GTC
21.1. The Rental Provider shall be entitled to amend these GTC unilaterally.
21.2. Any amendment to these GTC shall not affect Rental Agreements already concluded, unless otherwise agreed by the Parties jointly in writing.
21.3. Each rental shall be governed by the Rental Agreement and the version of these GTC accepted by the Renter when signing the Rental Agreement.
22. Final Provisions
22.1. Any matters not regulated by these GTC or the Rental Agreement shall be governed by Hungarian law, in particular the provisions of Act V of 2013 on the Civil Code.
22.2. If any provision of these GTC is invalid or unenforceable, this shall not affect the validity of the remaining provisions.
22.3. Any failure or delay by the Rental Provider in enforcing a right shall not constitute a waiver of that right.
22.4. The Parties shall primarily seek to resolve any disputes amicably through consultation.

2. Subject Matter and Scope of the General Terms and Conditions
2.1. These General Terms and Conditions / Rental Terms (hereinafter referred to as the "GTC") set out the general terms governing the electric bicycle rental services provided under the My eBike brand.
2.2. These GTC form an integral part of each individual electric bicycle rental agreement (hereinafter referred to as the "Rental Agreement") concluded between the Rental Provider and the Renter, and shall govern all matters not expressly regulated by the Rental Agreement.
2.3. These GTC shall apply exclusively to rental relationships where the Rental Agreement is concluded in person, in paper form, and signed by both Parties.
2.4. In the event of any inconsistency between the provisions of the Rental Agreement and these GTC, the individual provisions of the Rental Agreement shall prevail with respect to the relevant rental.
2.5. By signing the Rental Agreement, the Renter acknowledges and declares that, prior to conclusion of the Rental Agreement, they have received these GTC or have been given an adequate opportunity to review them, that they accept their provisions, and that they agree to be bound by them.
3. Definitions
3.1. Rental Provider: the service provider identified in Section 1 of these GTC.
3.2. Renter: a natural person who is at least 18 years of age and has full legal capacity, who enters into a Rental Agreement with the Rental Provider, rents the Bicycle for their own use or for the use of a User designated by them, and is responsible for fulfilling all obligations arising from the Rental Agreement.
3.3. User: the person who actually uses the Bicycle rented by the Renter.
3.4. Parties: the Rental Provider and the Renter, collectively.
3.5. Bicycle: the electric bicycle individually identified in the Rental Agreement and the Handover Report, including all of its accessories and equipment, unless otherwise provided in these GTC.
3.6. Accessory: any item supplied together with the Bicycle, including, but not limited to, a helmet, lock, key, charger, battery, repair kit, phone holder or any other accessory supplied with the Bicycle.
3.7. Rental Period: the period between the commencement and end date and time specified in the Rental Agreement, including any agreed extension thereof.
3.8. Partner: an accommodation provider or other cooperating entity that collaborates with the Rental Provider by recommending the Rental Provider's services to its guests or customers and, subject to the Renter's consent, may forward the Renter's enquiry to the Rental Provider. The Partner shall not become the rental provider under the Rental Agreement.
3.9. Price List: the Rental Provider's current schedule of fees, made available to the Renter in advance, including, in particular, rental fees, the Security Deposit, delivery and collection charges, and any other applicable fees.
4. Booking, Preliminary Arrangements and Conclusion of the Rental Agreement
4.1. The Renter may submit a rental request either directly to the Rental Provider or through a Partner. Subject to the Renter's consent, the Partner shall forward the enquiry to the Rental Provider. The Rental Provider shall then contact the Renter directly to arrange the details of the booking. A booking shall only become valid upon confirmation by the Rental Provider.
4.2. Any preliminary enquiry or request for quotation shall not in itself create a rental relationship. In all cases, the Rental Agreement shall be concluded in person, in paper form, and signed by both Parties. The provisions of Section 17 of these GTC shall otherwise apply to the relationship arising from a booking.
4.3. The Rental Provider shall be entitled to refuse the rental, in particular if:
a) the Renter is under 18 years of age;
b) the Renter's identity cannot be verified;
c) the Renter fails to pay the rental fee or the Security Deposit no later than the handover of the Bicycle;
d) in the opinion of the Rental Provider, the Renter is under the influence of alcohol, drugs or any other substance that may impair their ability to use the Bicycle safely;
e) based on the Renter's behaviour or physical or mental condition, the Renter is clearly unfit to use the Bicycle safely;
f) due to hazardous weather conditions, technical reasons, lack of availability or any other circumstance beyond the Rental Provider's control, the rental cannot be carried out safely;
g) the Renter refuses to sign the Rental Agreement or does not accept these GTC.
4.4. The Rental Provider reserves the right to offer a Bicycle of the same or a similar category instead of the Bicycle originally agreed if the originally agreed Bicycle is unavailable or cannot be handed over for technical, safety or other reasons. If no suitable replacement Bicycle is available, the Parties may cancel the rental by mutual agreement. In such case, any booking fee or rental fee paid in advance by the Renter shall be refunded. However, if the Renter refuses to accept the previously agreed and delivered Bicycle at the location for reasons not attributable to the Rental Provider, or cancels the rental on site, the Renter shall be obliged to pay the delivery charge, which the Rental Provider shall also be entitled to deduct from the booking fee.
4.5. By signing the Rental Agreement, the Renter warrants that all information provided by them is true, accurate and up to date.
5. Rental Requirements
5.1. The rental of a Bicycle is subject to the following conditions:
a) provision of the personal data required for performance of the Rental Agreement;
b) verification of the Renter's identity by means of a valid photographic identification document;
c) signing of the Rental Agreement and acceptance of these GTC;
d) payment of the rental fee and the Security Deposit; and
e) completion and signing of the Handover Report.
5.2. The Rental Provider shall be entitled to verify the Renter's identity by requesting presentation of a valid photographic identification document. The detailed rules governing the processing of personal data are set out in the Rental Provider's separate Privacy Notice.
5.3. The Renter may rent the Bicycle in their own name and at their own responsibility for their own use or for the use of a User designated by them. The Bicycle may not be handed over to any other person not previously designated, may not be sublet, and its use may not otherwise be transferred to another person. The Renter shall be liable for all damages and costs arising from any breach of this provision.
6. Rental Fee, Security Deposit and Payment
6.1. The rental fee, the Security Deposit, the delivery and collection charges, and the fees for any additional services shall be specified in the Rental Agreement and/or the Price List.
6.2. The rental fee constitutes consideration for the use of the Bicycle and for making it available for the Rental Period specified in the Rental Agreement.
6.3. Payment of the rental fee and the Security Deposit is a prerequisite for handover of the Bicycle.
6.4. The Rental Provider accepts the following methods of payment: cash; bank card; bank transfer; or any other method of payment agreed in advance by the Parties.
6.5. The Security Deposit serves as security for the Renter's contractual obligations. The amount of the Security Deposit shall be specified in the Rental Agreement in accordance with the Price List. The Security Deposit shall be refunded if the Bicycle and its Accessories are returned in accordance with the Rental Agreement, complete, undamaged and on time.
6.6. The Rental Provider shall be entitled to deduct from the Security Deposit any duly documented and reasonable costs, fees and damages arising from the Renter's breach of contract or from circumstances for which the Renter is responsible, including, in particular, repair, replacement, depreciation, cleaning, late return, recovery assistance, call-out, delivery or collection charges and costs. The detailed rules governing liability for damages are set out in Section 15 of these GTC.
6.7. The Security Deposit is provided as security and its amount shall not limit the Renter's liability for damages or other payment obligations. If the Rental Provider's duly documented loss, costs or other claim against the Renter exceed the amount of the Security Deposit, the Rental Provider shall be entitled to recover the outstanding balance from the Renter after applying the Security Deposit. The Renter shall pay any amount not covered by the Security Deposit within the deadline specified in the Rental Provider's written notice.
6.8. No interest shall accrue on the Security Deposit.
7. Handover of the Bicycle
7.1. The Bicycle shall be handed over at the location and time specified in the Rental Agreement.
7.2. The Bicycle may be handed over, in particular, at a handover point designated by the Rental Provider, at the Partner's accommodation, or at any other location agreed in advance by the Parties.
7.3. The Rental Provider shall hand over the Bicycle in a checked condition suitable for its intended use. Upon taking possession, the Renter shall inspect the Bicycle, its Accessories and its basic operation, and shall ensure that any visible defect, damage, missing item or objection is recorded in the Handover Report. If the Renter accepts the Bicycle without objection and signs the Handover Report, the Bicycle and its Accessories shall be deemed to have been received in the condition recorded therein.
7.4. The Rental Provider shall be entitled to refuse to hand over the Bicycle in any of the circumstances set out in Section 4.3 of these GTC.
7.5. If the Renter fails to appear at the handover time specified in the Rental Agreement, or if handover cannot be completed for reasons attributable to the Renter, the Rental Provider shall not be obliged to extend the Rental Period or provide an alternative handover time. The Parties may agree otherwise in writing on an individual basis.
8. Use of the Bicycle
8.1. The Bicycle may only be used by the Renter or the User designated by the Renter for its intended purpose, with due care, and in accordance with the information and instructions provided by the Rental Provider, the manufacturer's instructions, the Rental Agreement and these GTC.
8.2. The Renter shall ensure that both the Renter and the User are fit to use the Bicycle and comply with the rules governing its use as set out in these GTC and the Rental Agreement. The Renter shall be liable for the conduct of the User as if it were their own.
8.3. The Renter and the User shall comply with the applicable road traffic rules, in particular the Hungarian Highway Code (KRESZ). The Bicycle shall in all cases be used at the actual User's own risk.
8.4. The Renter represents and warrants that both the Renter and the designated User are in the physical, mental and health condition necessary for the safe use of the Bicycle and are familiar with the basic riding characteristics and features of an electric bicycle.
8.5. The use of a helmet is recommended while using the Bicycle. The Renter shall be responsible for the consequences arising from failure to wear a helmet.
8.6. The Bicycle may be used:
a) on public roads, in compliance with the applicable traffic regulations;
b) on cycle paths;
c) on light unpaved roads;
d) on gravel roads, provided that the road conditions allow safe use.
8.7. The Bicycle shall not be used:
a) on downhill tracks or in bike parks;
b) for jumping or racing;
c) on extreme off-road terrain;
d) in water, deep mud or any environment that may endanger the Bicycle's electrical system;
e) while under the influence of alcohol, drugs or any substance impairing the ability to operate the Bicycle safely;
f) for any unlawful purpose;
g) for carrying passengers or goods where such use is incompatible with the intended use of the Bicycle;
h) in any manner that endangers the Bicycle or the safety of the Renter, the User or any third party.
8.8. The Renter and the User shall not dismantle, modify or repair the Bicycle, battery, charger, GPS device or any other Accessory, nor arrange for their repair, alter them or interfere with their operation.
8.9. The Renter shall ensure that, whenever the Bicycle is not in use, it is locked and stored in a safe location and that all reasonable measures are taken to prevent theft, loss, damage or vandalism.
8.10. The Bicycle may only be transported with the prior consent of the Rental Provider. When transporting the Bicycle, the Renter or User shall take into account the weight and specific characteristics of the electric bicycle and shall use only suitable and secure bicycle transport equipment. The Renter shall be liable for any damage resulting from improper transportation.
9. Battery, Charging and Electrical System
9.1. The Renter and the designated User shall use the battery, charger and electrical system only for their intended purpose and in accordance with the information and instructions provided by the Rental Provider and the manufacturer's instructions. The Bicycle battery may only be charged using the charger supplied by the Rental Provider and a standard 220 V mains power supply.
9.2. The following are prohibited:
a) dismantling or opening the battery;
b) using a non-original charger or any charger other than that supplied by the Rental Provider;
c) immersing the battery in water, cleaning it with a high-pressure washer, or cleaning it in any manner that may endanger the electrical system;
d) modifying the electrical system in any way;
e) using a damaged battery or charger;
f) storing the battery in direct sunlight, near a heat source, or in a damp or otherwise unsafe location.
9.3. The Renter acknowledges that the Bicycle's range is affected by several factors, including, in particular, the weight of the actual User and any luggage, road conditions, elevation changes, weather, tyre condition, the level of pedal assistance and riding style. Any range information provided by the Rental Provider is for guidance only.
9.4. The Renter and the designated User shall monitor the battery charge level and plan the Rental Period, route and return journey accordingly. The Renter shall be responsible for any consequences arising from the User's failure to comply with this obligation.
10. GPS Tracking
10.1. The Renter acknowledges that the Bicycle is equipped with a GPS tracking device and shall also inform any designated User thereof.
10.2. The GPS device is intended in particular for the protection of the Bicycle, the prevention of theft, locating a lost or stolen Bicycle, and facilitating its recovery.
11. Breakdown and Assistance
11.1. The Renter shall immediately notify the Rental Provider of any breakdown, malfunction, damage or other circumstance preventing use of the Bicycle. Where the Bicycle is used by a designated User, the Renter shall ensure that the User immediately reports any defect or damage incident they observe either to the Renter or directly to the Rental Provider. The Renter shall be responsible for any consequences arising from the User's failure to do so.
11.2. In the event of a breakdown, the Renter or User may continue using the Bicycle only if, based on information provided by the Rental Provider, it is safe to do so. If continued use may aggravate the defect or create a risk of accident, use of the Bicycle shall cease immediately.
11.3. The Renter and the User shall not repair or arrange for the repair of the Bicycle without the prior consent of the Rental Provider.
11.4. In the event of a breakdown or damage incident, the Rental Provider shall provide telephone assistance and, following consultation with the Renter, determine the appropriate course of action. Subject to the conditions set out herein, the Rental Provider may provide recovery assistance during daytime hours at locations accessible by motor vehicle. Such assistance may include, in particular, on-site inspection, transportation or replacement of the Bicycle, or any other reasonable measure agreed with the Renter.
11.5. Where the breakdown results from the Renter's breach of contract, improper use by the Renter or User, culpable conduct (for example, inappropriate route selection or continuing to travel with a depleted battery), or another circumstance within the Renter's sphere of responsibility, the Renter shall bear all duly documented and reasonable resulting costs, including, in particular, repair, recovery, call-out or replacement costs, the mileage charge specified in the Price List, and any necessary material and labour costs.
11.6. Where the breakdown is attributable to the Rental Provider or occurs during proper use of the Bicycle, the Rental Provider shall, where reasonably possible, offer repair, replacement, recovery or another reasonable solution. If recovery is required due to a technical problem for which the Renter is not responsible, the Rental Provider shall provide recovery assistance free of charge during daytime hours, at a location accessible by motor vehicle and subject to available capacity.
11.7. Recovery assistance shall not constitute continuous availability or a guaranteed on-site repair service. It shall be provided solely subject to the Rental Provider's available capacity, opening hours, availability, weather and traffic conditions, and the geographical service area.
12. Damage, Accident, Theft and Loss
12.1. The Renter shall immediately notify the Rental Provider of any accident, theft, misappropriation, loss, damage caused to a third party or intervention by an authority.
12.2. In the event of an accident, personal injury, theft, misappropriation or damage caused to a third party, the Renter shall take any necessary official measures, including, in particular, making a police report or filing a criminal complaint where justified by the nature of the incident.
12.3. In the event of theft or misappropriation, the Renter shall immediately notify the Rental Provider, file a police report, provide proof thereof to the Rental Provider, and cooperate in locating the Bicycle.
12.4. The Renter shall provide a truthful account of the circumstances of any damage incident. The incident shall be recorded by the Parties or, where necessary, by the Renter on a damage report form or in a written record.
12.5. The Renter shall assist in documenting the incident, including, where it is safe to do so, by taking photographs of the location, the Bicycle, and any damage or missing items.
13. Return of the Bicycle
13.1. The Renter shall return the Bicycle together with all Accessories at the time and location specified in the Rental Agreement.
13.2. The Bicycle shall be returned in a clean and readily inspectable condition. Dust resulting from normal use shall not constitute a breach of contract.
13.3. If the Bicycle is returned muddy, excessively dirty or in a condition requiring special cleaning by the Rental Provider, the Rental Provider shall be entitled to charge the cleaning and maintenance fee specified in the Price List.
13.4. The Bicycle shall not be cleaned using a high-pressure washer. The Renter shall be liable for any damage resulting from high-pressure cleaning, improper cleaning or water ingress into the electrical system.
13.5. Upon return, the Rental Provider shall inspect the condition of the Bicycle and its Accessories. Any damage, missing items, excessive dirt, late return and any circumstances relevant to settlement of the Security Deposit shall be recorded in the Handover Report or in a separate written record.
13.6. Unless otherwise agreed, the Renter shall not be entitled to a proportional refund of the rental fee if the Bicycle is returned before the end of the Rental Period.
13.7. The Renter shall not retain possession of the Bicycle or its Accessories on the grounds of any actual or alleged claim, objection or demand against the Rental Provider. Any such claim may be pursued separately, independently of the obligation to return the Bicycle.
14. Late Return
14.1. A return shall be deemed late if the Renter fails to return the Bicycle by the return time specified in the Rental Agreement. The Renter shall immediately notify the Rental Provider of any delay.
14.2. Unless otherwise agreed, the Rental Provider allows the following grace period: 30 minutes for hourly rentals and 1 hour for daily rentals.
14.3. Where the delay exceeds the applicable grace period, the Rental Provider shall be entitled to charge the late return fee specified in the Price List.
14.4. If the delay causes the Rental Provider to incur additional loss or costs, or prevents performance towards another renter, the Rental Provider shall be entitled to recover duly documented loss exceeding the late return fee.
14.5. If the Renter fails to return the Bicycle within 24 hours after expiry of the Rental Period and fails to cooperate with the Rental Provider, the Rental Provider shall be entitled to take the asset-protection, official and legal measures necessary to locate and recover the Bicycle.
14.6. The Rental Period may only be extended with the prior consent of the Rental Provider and subject to availability. The Renter shall discuss any requested extension with the Rental Provider by telephone before expiry of the Rental Period and subsequently confirm the request by e-mail. The extension shall only be deemed accepted if the Rental Provider confirms it by e-mail, issues an invoice for the extension fee and the Renter pays the extension fee specified in the Price List. By submitting a request for an extension, the Renter acknowledges that acceptance of the extension will give rise to an additional payment obligation.
15. Liability, Damage and Allocation of Loss
15.1. The Renter shall be liable for all damages and costs arising from the Renter's breach of contract, improper use by the Renter or User, negligent or intentional conduct, breach of traffic regulations, or breach of the rules concerning use and safeguarding set out in these GTC or the Rental Agreement.
15.2. The Renter's liability includes, in particular, loss of, missing parts of or damage to the Bicycle or its Accessories; circumstances attributable to the Renter in connection with theft or misappropriation; damage to the battery, charger, GPS device or electrical system; damage resulting from improper transportation; and any fines, surcharges or other costs imposed on the Rental Provider where attributable to the conduct of the Renter or User.
15.3. Normal wear and tear resulting from proper use shall not constitute damage.
15.4. The Renter shall be released from liability if they prove that the damage did not result from the conduct of the Renter or User, from improper use of the Bicycle, or from a circumstance within the Renter's sphere of responsibility.
15.5. The amount of damage shall be determined by the Rental Provider on the basis of the nature of the damage, the expected or actual repair or replacement costs, depreciation and, where necessary, a quotation from a service provider or distributor. The Rental Provider shall inform the Renter of the basis of the assessment.
15.6. The Renter shall reimburse the cost of repairing or replacing the Bicycle or any Accessory and, where economical repair is not possible, or in the event of destruction, loss or failure to return it, the replacement value thereof, together with any duly documented related costs.
16. Insurance
16.1. Unless otherwise stated in writing, the Rental Provider does not provide insurance services.
16.2. The Renter acknowledges that, in connection with use of the Bicycle, it is the Renter's responsibility to arrange any accident, health, property or liability insurance they consider necessary for themselves and, where applicable, for the designated User.
17. Booking, Cancellation and Amendments
17.1. If the Renter wishes to amend or cancel a previously arranged rental date, they shall notify the Rental Provider as soon as possible. The Rental Provider shall only be obliged to accommodate a requested amendment subject to availability. For an advance booking, the Rental Provider shall charge the fee specified in the Price List, which shall be credited towards the rental fee.
17.2. If the Renter fails to appear at the booked time or fails to take possession of the Bicycle for reasons attributable to the Renter, the Rental Provider shall be entitled to cancel the advance booking. In such case, the advance booking fee already paid shall be non-refundable. The Renter may cancel the rental free of charge no later than 72 hours before commencement of the rental, in which case the advance booking fee shall be refunded.
17.3. The Rental Provider shall be entitled to cancel or amend the rental or advance booking without liability for damages if justified by exceptional weather conditions, technical failure, risk of accident, lack of availability or any other circumstance beyond the Rental Provider's control (force majeure). In such case, the Rental Provider shall, where reasonably possible, offer an alternative date, another Bicycle or another fair solution; failing this, any advance booking fee already paid shall be refunded.
18. Warranty
18.1. The Rental Provider warrants that, at the time of handover, the Bicycle is suitable for its intended use.
18.2. The Renter shall not be entitled to make a claim in respect of any cosmetic defect or damage that does not prevent the intended use of the Bicycle and that was known at the time of handover or recorded in the Handover Report.
18.3. If, during the Rental Period, the Bicycle becomes unusable for reasons not attributable to the Renter or User, the Rental Provider shall proceed in accordance with Section 11.
18.4. The Rental Provider shall not be liable where use of the Bicycle is prevented by a circumstance attributable to the Renter or User, including, in particular, improper use, inappropriate route selection, inadequate physical condition, improper handling of the battery, or weather, road or other conditions not attributable to the Rental Provider.
19. Data Protection
19.1. The detailed rules governing the processing of the personal data of the Renter and, where applicable, the User are set out in the Rental Provider's Privacy Notice.
20. Complaints Handling
20.1. The Renter may submit any complaint relating to the rental, the Bicycle or the Rental Provider's services using the contact details specified in Section 1.
20.2. The Rental Provider shall, where possible, examine verbal complaints immediately and remedy them as necessary. If immediate investigation of a verbal complaint is not possible, or if the Renter does not agree with the handling of the complaint, the Rental Provider shall prepare a written record.
20.3. The Rental Provider shall provide a substantive written response to a written complaint within 30 days of receipt. If the complaint is rejected, the Rental Provider shall state the reasons for its position.
20.4. In the event of a consumer dispute, the Renter shall be entitled to apply to a conciliation body.
